Terms of Service

These terms govern your use of the Kickstand.ie website and services (the “Service”), provided by Kickstand.ie of 1 Sample St, Dublin 1, D01 ABC1, Ireland. By creating an account or posting a listing, you agree to these terms.

1. The marketplace, in plain English

Kickstand is an online marketplace that lets riders in Ireland list and discover motorcycles. We are not a party to any sale, we do not take payment, and we do not handle delivery or escrow. The listing seller and the buyer transact directly with one another.

We provide the Service on an “as-available” basis and may add, change, or remove features at any time without notice.

2. Your account

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
  • You are responsible for keeping your password secure and for all activity on your account.
  • One account per person. Do not impersonate anyone else or create accounts on behalf of others without permission.
  • You can delete your account and all associated personal data at any time from your profile page.

3. Listings — your obligations as a seller

  • Information you post (year, mileage, condition, history) must be accurate to the best of your knowledge.
  • You must own the motorcycle you list, or have the owner's explicit permission to sell it.
  • You must be lawfully entitled to sell the motorcycle in Ireland — no stolen vehicles, no vehicles with outstanding finance you have not disclosed, no vehicles with tampered identification numbers.
  • Trade sellers (anyone selling motorcycles in the course of a business) must clearly identify themselves as a trader, including business name and address, and must comply with the Sale of Goods and Supply of Services Act 1980 and the Consumer Rights Act 2022.
  • Photos must be of the actual motorcycle for sale. Stock images alone are not allowed for used listings.
  • You retain ownership of the content you post but grant us a non-exclusive licence to host, display, and reproduce it on the Service for the duration of the listing plus 90 days after.

4. Prohibited use

You may not use the Service to:

  • Post anything illegal, fraudulent, or misleading.
  • List stolen vehicles or vehicles without a verifiable registration / VIN.
  • Sell parts that are illegal to use on Irish public roads (e.g. de-cat exhausts, race-only ECUs presented as road-legal).
  • Post a listing on behalf of a trader while pretending to be a private seller.
  • Harass, threaten, or send unsolicited bulk messages to other users.
  • Solicit payment off-platform via methods designed to defraud (gift cards, crypto-only, courier-only without prior viewing, etc.).
  • Scrape, mass-download, or otherwise abuse the Service in a way that degrades it for other users.
  • Bypass rate limits or any technical access controls.
  • Impersonate Kickstand or other users.
  • Post content that infringes intellectual-property rights.

5. Reporting illegal content (EU Digital Services Act)

Under the EU Digital Services Act (Regulation (EU) 2022/2065), you can report content you believe to be illegal at any time:

  • Use the “Report listing or seller” control on any listing page.
  • Use the “Report this conversation” control inside any private message thread.
  • For anything else, email support@kickstand.ie with a description of the content, the URL, and the legal basis for your report.

We will acknowledge receipt promptly and decide on the report within a reasonable timeframe. We will tell you what we decided and the reasons. If your content is removed and you believe the decision was wrong, you may appeal by replying to our decision email; an appeal is reviewed by a different person where possible. You can also bring disputes to a certified out-of-court dispute settlement body in Ireland.

6. Suspension and termination

We may restrict, suspend, or terminate your account or remove your content if:

  • You materially breach these terms.
  • You repeatedly post listings that violate the prohibited-use list.
  • We are required to do so by law or a valid order from an Irish authority.
  • We have a good-faith belief your activity is fraudulent or endangers other users.

We will normally give you reasons and an opportunity to respond. For serious violations (fraud, illegal content, threats) we may act immediately. You may appeal any moderation decision via the email in Section 5.

7. Fees

Posting a listing on Kickstand is currently free. We reserve the right to introduce paid features (e.g. featured listings, dealer subscriptions) in the future, with at least 14 days' notice and clear pricing before any charge applies.

8. Disclaimers

  • Listings are submitted by users. We do not pre-verify accuracy. You must satisfy yourself that any motorcycle is as described before paying for it.
  • Reg-lookup data comes from a third-party (MotorCheck). We don't guarantee its accuracy or completeness.
  • We provide no warranty that the Service will be uninterrupted, bug-free, or available at any particular time.

9. Limitation of liability

To the fullest extent permitted by Irish law, Kickstand will not be liable for indirect or consequential losses, lost profits, lost data, or losses arising from off-platform transactions, disputes between users, or content posted by users. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.

Where liability is not excluded, our aggregate liability to you in any 12-month period will not exceed €100 or the fees you have paid us in that period, whichever is greater.

10. Changes to these terms

We may update these terms from time to time. The “Last updated” date above will reflect the most recent change. For material changes we will give you reasonable advance notice by email or an in-app banner. Continued use of the Service after a change means you accept the updated terms.

11. Governing law and jurisdiction

These terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction over any dispute, except that consumers may also rely on any mandatory protections available to them under the law of their country of residence.
